These Terms of Service ("Terms") constitute a legally binding agreement between you ("user," "you," or "your") and MOVITECH LIMITED ("Company," "we," "us," or "our") governing your use of all mobile games, applications, websites, and related services (collectively, "Services") developed and published by MOVITECH LIMITED and available through Google Play, the Apple App Store, or any other distribution platform.
By downloading, installing, accessing, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.
You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use our Services. If you are under the age of 18 (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using our Services, you represent and warrant that you meet these eligibility requirements.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use our Services on a compatible mobile device that you own or control, solely for your personal, non-commercial entertainment purposes.

Our Services may offer in-app purchases ("IAPs") that allow you to purchase virtual items, currency, or other content. All IAPs are processed through the applicable platform provider (Google Play or Apple App Store) and are subject to their respective terms and conditions.
All content, materials, and elements within our Services — including but not limited to text, graphics, logos, icons, images, audio clips, video clips, animations, software code, game design, characters, storylines, and user interfaces — are the exclusive property of MOVITECH LIMITED or our licensors and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws.
The MOVITECH LIMITED name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of MOVITECH LIMITED. You may not use such marks without our prior written permission.
If our Services allow you to submit, upload, post, or share content (such as reviews, comments, screenshots, or user names), you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the operation and promotion of our Services.
You represent and warrant that you own or have the necessary rights to grant this license and that your content does not infringe the intellectual property or other rights of any third party.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY DEFECTS WILL BE CORRECTED OR THAT THE RESULTS OBTAINED FROM THE USE OF OUR SERVICES WILL BE ACCURATE OR RELIABLE.
YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OR ALL OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOVITECH LIMITED, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY US DOLLARS ($50.00), WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless MOVITECH LIMITED, its directors, officers, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit through the Services.
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Services will cease immediately.
You may stop using the Services at any time by uninstalling the applicable game or app from your device. Provisions of these Terms that by their nature should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
We reserve the right to modify, update, suspend, or discontinue any part of our Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
We may also revise these Terms from time to time. The updated Terms will be posted within the Services or on our website, and the "Last Updated" date will be revised. Your continued use of the Services following the posting of revised Terms constitutes your acceptance of those changes.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MOVITECH LIMITED is incorporated, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration authority in the jurisdiction of incorporation.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
These Terms, together with our Privacy Policy and any other legal notices or policies published by us within the Services, constitute the entire agreement between you and MOVITECH LIMITED regarding the use of our Services, and supersede all prior agreements and understandings, whether written or oral.
The failure of MOVITECH LIMITED to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by MOVITECH LIMITED.
